A Bill to allow Magistrates’ Courts discretion to refer a third or subsequent offence for driving whilst disqualified to the Crown Court for sentencing; and to grant the Crown Court the jurisdiction to impose a custodial sentence of up to two years for such offences.
House of Commons
15 May 2014
The Bill would let magistrates’ courts refer a driver’s third or later offence of driving while disqualified to the Crown Court for sentencing. The Crown Court would then be able to impose a custodial sentence of up to two years for those offences. It is designed to clamp down on repeat disqualified-driving by providing a tougher sentencing route.
The Bill is currently at the second reading in the House of Commons. If it progresses, it would move on to committee stage and further readings.
